I-485 Stuck for Over a Year? Here Are Your Options

The I-485 (Application to Register Permanent Residence or Adjust Status) is one of the most important immigration forms you will ever file. It is also, unfortunately, one of the most commonly delayed. If your I-485 has been stuck for over a year, here is what you can do about it.

Check Your Processing Times

The first step is to verify that your case is actually outside normal processing times. Visit the USCIS processing times page and check the current average for your specific form type, category, and service center. Processing times vary significantly depending on these factors.

Submit a Service Request

If your case is outside posted processing times, you can submit an e-Request through your USCIS online account. You can also call the USCIS Contact Center at 1-800-375-5283. Be aware that these channels often result in generic responses, but they create a paper trail that can be helpful later.

Congressional Inquiry

Contacting your U.S. Senator or Representative can sometimes help move a stalled case. Their offices have dedicated liaisons who can contact USCIS on your behalf. Results vary, but this is a free option worth trying.

Ombudsman Complaint

The USCIS Ombudsman is an independent office within DHS that can help resolve problems with USCIS. Filing a complaint with the Ombudsman can sometimes prompt action, though response times from this office have also increased.

Mandamus Lawsuit

If the above steps have not produced results, a mandamus lawsuit is often the most effective remaining option. This is a federal lawsuit that asks the court to order USCIS to adjudicate your case.
